COURT SAYS: SAME-SEX COUPLES DESERVE RIGHTS, LEGISLATURE PICKS THE NAME

FOR IMMEDIATE RELEASE:

October 25, 2006 Trenton: The New Jersey Lesbian and Gay Coalition is thrilled by the recent decision of the State Supreme Court which recognizes that providing to “committed same-sex couples the financial and social benefits and privileges given to their married heterosexual counterparts” is mandated under the State Constitution. The New Jersey State Supreme Court has upheld equal rights for the all citizens. By leaving the “name to be given to the statutory scheme that provides full rights and benefits to same-sex couples, whether marriage or some other term, is a matter [left to the legislature]” we look forward to a speedy process that reflects the diversity of New Jersey. We have faith that all fair-minded citizens of NJ agree with the Court’s decision.

This is great news, and congrats to NJLGC and the activists and their nimble legal advocates who brought this about!

But my very analytical SO tempered her enthusiasm with the thought that this might be sort of an "October surprise" that brings out the fundies on Election Day. Yikes. Hope not.

I think the court stopping short of extending marriage and pushing the form of remediation back to the legislature largely deflects the issue for the election. It just gives the candidates yet another chance to restate their opinions. I don't think this is a surpise to anyone--if anything, I'm surprised they didn't just go ahead and extend marriage rights.

I think it's 180 days for the legislature to do something.

It would be interesting if they simply extended current marriage laws to same-sex couples. Wouldn't civil unions be struck down under the "separate but equal" precedent?

Governor has previously said he would sign such a bill. Now we see if he keeps it up. A bill is about to be introduced.

Great! I know that in Masachusetts, marriage is limited to residents and those who intend to reside in MA; is there any similar limitation in NJ?

It was a 4-3 decision, but the dissenting opinion was not that the state Constitution didn't afford equal rights to same sex couples, but that in fact the court should have made marriage equal to same-sex and opposite-sex couples.

No one on the court held the opinion that the constitution didn't allow for same-sex rights akin to opposite-sex marriage.

He has threatened to sue GLBT community members that have publicly critiqued him so I will refrain from saying anything.

(STEVE: You can easily prove me wrong by sending a certified letter to me stating that you are not currently pursuing the lawsuit that you alluded to in email on August 18, 2006. You can also put a copy of that letter on your web site. And if you think I'm being petty, then the certified letter can say that too.)
